Copyright and Content Policy

Shaw Hockey Productions, LLC (“Shaw”) does not and will not use any copyrighted music for any video we produce.  We apologize for any inconvenience, but our policy protects both our clients and our company. Thank you for understanding.

Client Owned Photographs, Video and/or Music. If Client provides any photographs, video footage or music to Shaw (“Client Material”), Client hereby represents that Client is the sole owner of the Client Material and that Client has the full right, power and authority to enter into this Agreement and to grant Shaw the authority to use such Client Material in the production and editing of the Video. Client further represents and warrants to Shaw that the Client Material does not infringe upon any common law or statutory rights in any other literary, dramatic, or other material; that no material in the Client Material is libelous or violative of the right of privacy of any person and the full use of the rights in the Client Material which are covered by this Agreement would not violate any rights of any person, firm or corporation.  Shaw may require that any and all photography and or videography produced by any third party other than the parents or athlete, be accompanied by a letter/email of permission sent to Shaw by the client/producer in order for us to use on any client video.

We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe any materials accessible on or from ShawHockey.com or its social media pages and platforms (the “Sites”) infringe your copyright, you may request removal of those materials (or access to them) from the Sites by submitting written notification to info@shawhockey.com, in accordance with the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”).  If you fail to comply with all the requirements of section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.  Please be aware that if you knowingly materially misrepresent that material or activity on the Sites is infringing your copyright, you may be held liable for damages (including costs and attorneys’ fees) under section 512(f) of the DMCA.

Indemnification

You agree to indemnify, defend and hold harmless Shaw and our members, managers, affiliates, partners, agents, contractors, licensors, service providers, suppliers, interns, assigns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of this Policy or the documents they incorporate by reference, or your violation of any law or the rights of any third-party.

Related Terms

Notwithstanding anything to the contrary in this Policy, the Terms and Conditions, Privacy Policy, and Purchase, Return and Refund Policy posted on Shawhockey.com are incorporated herein by this reference, and in the event of any conflict in terms, the Terms and Conditions shall control.
